To check whether a granted patent specification (see Status) or a possibly still pending patent application that claims a novel product, process or technical usage may pose a threat to your business or is expected to do so is valid or invalid OSIP Search & Watch can execute a so-called "Validity search" for you. With validity is meant whether a patent protects an invention or innovation that is new, inventive and applicable as claimed (see Patentability). Testing the validity yields an answer as to how strong the claim of that patent or application is or will be and possibly can provide you with a starting point for nullifying, limiting or working around the patent at hand (see also Opposition and Nullity).
OSIP Search & Watch can perform a focussed and effective Validity search for you by means of searching in professional patent data bases worldwide and report the results to you in a handy electronic format.
The cost for a feasibility search in the patent literature amounts to the number of spent hours of searching times our hourly rate increased by the costs incurred for data base usage, and any additional document fees. On the order of 700 – 1200 euro (ex VAT) is normally expected. Please bear in mind a turnaround time of ordinarily 5 – 10 working days. The search does not have to be restricted to the patent literature only. As applicable it can sometimes be advisable or even necessary to supplement the patent search by searching the open (scientific/technological) literature, newsprint, magazines etc. Extra costs of a few hundreds of euros are incurred and a few extra days of turnaround time are added in that case.
