Patentability

A patent is a technical solution to a technical problem. You wish, for instance, to develop a novel product, process or a novel use; however, you would rather not be reinventing "the wheel" and do any double work. In order for your potential invention or innovation to qualify for patenting, the following three conditions should at least be met, viz.:

For novelty it is of importance that your invention or innovation was not yet made public elsewhere, by anyone else including yourself. For inventivity it is of importance that your invention or innovation is not obvious for the average expert in the field of invention. For industrial applicability it is of importance that technical use of your invention really is possible or that your invention can be made to work following the text of your patent. So the disclosure must be technically enabling. A so-called "Patentability search" will provide you with the answer.

The cost for a Patentability search in the patent literature amounts to the number of spent hours of searching times our hourly rate increased by the costs incurred for data base usage, and any additional document fees. On the order of 700 – 1200 euro (ex VAT) is normally expected. Please bear in mind a turnaround time of ordinarily 5 – 10 working days. The search does not have to be restricted to the patent literature only. As applicable it can be advisable or even necessary to supplement the patent search by searching the open (scientific/technological) literature, newsprint, magazines etc. Extra costs are incurred and a few extra days of turnaround time are added in that case.

Based on the findings in our report you may decide to apply for a patent in the Netherlands directly yourself, or with the help of a patent lawyer or attorney, at "Nederlands octrooicentrum", a national Dutch Government agency in The Hague, or regionally at the European Patent Office in Rijswijk via the respective on-line available registration forms (see webform link on NL form, and EPO form 1001").
